Before you read this: what this document is for

You trust me with a lot — how your brain works, what's hard right now, the stuff you haven't said out loud anywhere else. That trust matters, and so does being straight with you about what happens to your information when you work with me.

This policy explains what I collect, why, how it's stored, who (if anyone) sees it, and what choices you have. I've tried to write it the way I'd explain it out loud — plainly, and without the fine print doing the opposite of what it says.

This policy applies to [morningtidewellness.com] (the "Site"), and to my coaching services, scheduling, and payment processes (together, the "Services"), operated by [Charlotte LaVictoire / Morningtide Wellness ADHD Coaching, LLC] ("Morningtide," "I," "me," or "we").

1. Who this policy covers

This policy applies to visitors to the Site, prospective clients who book a call or fill out a form, and current or former coaching clients. If you're a minor, please note: my services are designed for adults, and I do not knowingly collect personal information from anyone under 18.

2. What information I collect

Information you give me directly:

  • Name, email address, phone number

  • Information shared in intake forms, discovery calls, or coaching sessions (this may include things related to your ADHD/AuDHD experience, health, work, family, or other personal circumstances you choose to share)

  • Payment and billing information (processed by Stripe — see Section 5)

  • Any messages, emails, or scheduling details you send me

Information collected automatically when you visit the Site:

  • IP address, browser type, device information

  • Pages visited, time on page, referring URLs

  • Cookies and similar tracking technologies (see Section 8)

Information from third-party tools I use to run my practice:

  • Scheduling data from my appointment platform (e.g., Acuity)

  • Payment and subscription data from Stripe

  • Email or newsletter engagement data, if you're subscribed to my list

I do not collect Social Security numbers, government ID numbers, or full payment card numbers directly — those go straight to Stripe (more below).

3. Why I collect it

I use your information to:

  • Provide and manage coaching services, including scheduling and session notes

  • Process payments and manage billing

  • Communicate with you about appointments, invoices, or your account

  • Send occasional newsletters or program updates, if you've opted in

  • Improve the Site and understand how people use it

  • Meet legal, tax, and accounting obligations

  • Protect against fraud, abuse, or security issues

My legal basis for processing this information (for visitors in regions requiring one, such as the EU/UK) is: performance of a contract (coaching services and payment), your consent (marketing communications), and legitimate business interests (Site analytics, security).

4. A note on health-related information

Coaching conversations often touch on things that sound like health information — attention, executive function, sleep, emotional regulation, and so on. Here's what's important to know:

  • ADHD coaching is not medical care, mental health treatment, or therapy, and I am not acting as a healthcare provider. This means the confidentiality protections that apply to a doctor's or therapist's office (like HIPAA) do not automatically apply to information shared in coaching.

  • I still treat what you share as private and handle it with care, as described throughout this policy. I don't sell it, and I don't share it beyond what's described in Section 5.

  • If a state law (such as California's) classifies information you share as "sensitive personal information," I limit its use to providing the Services and do not use it to infer characteristics about you beyond that purpose.

If you're looking for a therapist or medical provider, I'm glad to point you toward resources — coaching and clinical care work well together, and I want you to have both if you need them.

5. Who I share information with

I don't sell your personal information. Full stop. I share it only in these situations:

Each of these providers is only permitted to use your information to perform the service they provide me — not for their own marketing purposes, except as described in their own privacy policies (which I encourage you to review, particularly Stripe's).

6. How long I keep your information

I keep client information for as long as needed to provide services, meet legal/tax record-keeping requirements (typically 3–7 years depending on the record type), and maintain accurate business records. Site analytics data is generally retained for up to 26 months. You can request earlier deletion of your personal information as described in Section 9, subject to legal retention requirements.

7. How your information is protected

I take reasonable administrative and technical steps to protect your information — including using reputable, secure third-party platforms (Stripe, my scheduling tool, my email platform) rather than storing sensitive data myself, using secure passwords and access controls, and limiting who has access to client records (in most cases, that's just me).

No system is 100% secure, and I can't guarantee absolute security — but I take this seriously, and I'll notify you if a breach affects your personal information, as required by law.

8. Cookies and tracking

The Site uses cookies and similar technologies to understand how visitors use it and to keep it running smoothly. This may include:

  • Essential cookies — needed for the Site to function

  • Analytics cookies — to understand traffic and usage patterns

  • Marketing cookies — if applicable, for tracking engagement with ads or campaigns

You can control cookies through your browser settings, and where required, I'll provide a cookie consent option on the Site. I honor Global Privacy Control (GPC) and similar opt-out signals where legally required.

9. Your rights

Depending on where you live, you may have the right to:

  • Know what personal information I have about you

  • Request a copy of it

  • Correct inaccurate information

  • Request deletion

  • Opt out of the sale or "sharing" of personal information (I don't sell or share information in this way, so this is a non-issue in practice — but you still have the right to ask)

  • Opt out of marketing emails at any time (there's an unsubscribe link in every email)

  • Not be discriminated against for exercising these rights

If you're a California resident, you have rights under the CCPA/CPRA, including the right to know, delete, correct, and limit use of sensitive personal information.

If you're a resident of another U.S. state with a comprehensive privacy law (including but not limited to Colorado, Connecticut, Virginia, Utah, Oregon, Texas, and others as they take effect), you may have similar rights.

If you're located in the EU/UK, you have rights under GDPR, including the rights above plus data portability and the right to lodge a complaint with your local supervisory authority.

10. International visitors

The Site and Services are based in the United States, and information is generally processed and stored in the U.S. If you're accessing the Site from outside the U.S., your information will be transferred to and processed in the U.S., where privacy laws may differ from those in your home country.

11. Children's privacy

My Services are intended for adults. I don't knowingly collect personal information from anyone under 18. If you believe a minor has provided personal information to me, please contact me and I'll delete it.

12. Changes to this policy

I'll update this policy as my practice, tools, or the law changes. The "Last Updated" date at the top reflects the most recent version. If changes are significant, I'll post a notice on the Site or notify current clients directly.
